Terms and Conditions - aqooa

1. Purpose

These General Terms and Conditions of Sale (hereinafter referred to as the "GTCS") govern the terms and conditions of subscription, use, cancellation and invoicing of water purification system subscriptions and sales offered by Aqooa (hereinafter referred to as "Aqooa").

Any subscription or purchase implies full acceptance of these GTC.

2. Service description

Aqooa offers two types of services:

2.1. Subscription

Monthly subscription includes :

  • The supply of a water purification system (hereinafter referred to as the "Equipment"), depending on the package subscribed to;
  • Installation of the Equipment in the home by a professional appointed by Aqooa;
  • Preventive and corrective maintenance of the Equipment for the duration of the subscription;
  • The supply of filter cartridges at regular intervals, which the customer installs himself.

2.2. Firm sale of the Equipment

The customer also has the option of purchasing the Equipment outright, without a subscription.

The precise characteristics of each offer (Equipment model, speed, features, etc.) are described on the www.aqooa.me website and on the associated product sheet.

3. Subscription and activation

Subscriptions or purchases are made online at www.aqooa.me.

  • The subscription begins once the order has been validated and the Equipment has been installed.
  • The firm sale of the Equipment is effective as soon as payment has been validated.

4. Subscription duration and renewal

Subscriptions are non-binding and are automatically renewed from month to month until terminated.

5. Subscription cancellation conditions

Customers may cancel their subscription at any time, without incurring any cancellation charges.

To cancel, the customer must send a request by e-mail to the following address: contact@aqooa.me.

Termination will take effect at the end of the current monthly period.

6. Obligation to return Equipment (for subscriptions only)

6.1. Return

In the event of termination of the subscription, the customer undertakes to return the Equipment complete and in good working order within a maximum period of 30 days following the date of termination.

The Equipment is returned at the customer's expense, in accordance with the terms and conditions communicated by Aqooa.

6.2. Damage or non-return

In the event of failure to return the Equipment within the allotted time, partial return or return of damaged Equipment, Aqooa reserves the right to charge the customer :

  • The value of the Equipment, indicated on the product sheet corresponding to the subscription taken out, available on the www.aqooa.me website at the time of subscription;
  • Installation costs, fixed at €190 incl. VAT.

These sums are due immediately and may be debited from the payment method used by the customer at the time of subscription.

7. Conditions applicable to firm sales (excluding subscriptions)

7.1. Right of withdrawal

In accordance with the regulations applicable to distance selling, the customer has a period of fourteen (14) calendar days from receipt of the Equipment to exercise his right of withdrawal without having to justify his decision or pay any penalties.

To exercise his right of withdrawal, the customer must notify his decision to Aqooa by e-mail to contact@aqooa.me, expressing unequivocally his desire to withdraw.

7.2. Equipment return

The customer must return the Equipment, at his own expense, in its original packaging, complete and in perfect condition for resale, within a maximum period of fourteen (14) days following communication of his decision to withdraw. Aqooa will specify the terms of return.

Any Equipment returned incomplete, damaged or used beyond what is necessary to establish its nature, characteristics and proper functioning may be subject to a discount or refusal of reimbursement.

7.3. Installation costs

In the event of installation services being provided at the customer's request before expiry of the withdrawal period, the installation costs incurred remain payable and are not refundable. The fixed amount for these installation costs is €190 including VAT.

7.4. Refund

Aqooa will refund the sums paid for the purchase, less any discounts and non-refundable installation costs, within a maximum period of fourteen (14) days following receipt and verification of the returned Equipment.

8. Maintenance access (subscriptions)

The customer undertakes to allow Aqooa technicians access to the customer's home solely for the purpose of carrying out maintenance operations necessary for the proper operation of the Equipment.

Routine maintenance and filter replacement are carried out directly by the customer, based on instructions provided by Aqooa.

9. Prices and payment terms

9.1. Prices

Prices are indicated in euros, inclusive of all taxes, and are those in force on the day of subscription or purchase, as presented on the www.aqooa.me website.

9.2. Payment

  • For subscriptions: payment is made by monthly direct debit to the payment method indicated at the time of subscription. In the event of non-payment, Aqooa is entitled to suspend the subscription until payment has been made.
  • For firm sales: payment is due in full when the order is placed.

10. Customer's obligations

The customer undertakes to :

  • Use the Equipment in accordance with the instructions and recommendations provided;
  • Carry out the replacement of filter cartridges in accordance with the preventive maintenance schedule;
  • Report any malfunction to Aqooa as soon as you notice it;
  • Allow access to your home for technical maintenance operations if necessary (subscriptions).

11. Warranties and liability

11.1 Warranty

Aqooa guarantees the proper functioning of the Equipment:

  • For the duration of the subscription ;
  • For two (2) years from delivery for firm sales, in accordance with applicable legal warranties (warranty of conformity and warranty against hidden defects).

11.2. Limitation of liability

Aqooa shall not be liable for any indirect damage resulting from the use of the Equipment.

Aqooa's liability is strictly limited to the services expressly provided as part of the subscription or sale.

12. Personal data

The personal data collected is required to manage the contractual relationship and is processed in accordance with the Privacy Policy available on the www.aqooa.me website .

Customers have the right to access, rectify and delete their data at any time by contacting Aqooa at contact@aqooa.me.

13. Applicable law and jurisdiction

These terms and conditions are governed by French law.

In the event of a dispute, the parties will endeavor to find an amicable solution. Failing this, the competent courts will be those within the jurisdiction of Aqooa's registered office.
